Regulation and Environmental Risks

Objectives

On successful completion of this course, participants will be able to:

              I.        Understand Risk Regulation Theory and the application of the main concepts in the context of environmental risk;

             II.        Identify the rules of Environmental Risk Assessment in the sphere of International Law, European Union Law and Portuguese Law and their application in various concrete cases;

            III.        Understand the basic concepts of risk assessment and perception and their application in specific cases;

            IV.        Analyse risk regulatory instruments in specific sector regulations.

Evaluation method

The assessment will be based on the following options, which will count for 100% of the final grade.

All assignments and exams will be checked for plagiarism. If plagiarism is detected, a negative mark will be awarded.



 



CONTINUOUS ASSESSMENT: Students will be assessed on the basis of a continuous assessment model consisting of the following parts:



 



 



Class participation (group work) - 10%



Continuous assessment is an assessment method awarded to students with high attendance. Class participation will be assessed through two group assignments, which correspond to activities given to students at the end of Part II and Part III and developed in discussion groups.



 



Individual presentation (Workshop) - 10%.



 



The workshop is a session dedicated to students presenting a first draft of their case study and obtaining feedback from the teacher and/or guest speakers.



 



Case study essay - 80%



 



A case study essay is a short, critical commentary on an important case study on an EIA or a concrete case involving the application of an environmental risk regulation ("case study").

By the end of Part III, an Excel will be made available where each student can indicate the topic and case study they wish to address in the essay. No two or more students may write about the same case study.



 



2. Structure of your case study



Case studies have a more flexible structure than case notes. However, it is possible to find some common elements, including the identification and description of a specific case, the legal framework relevant to the issue, an analysis of whether or not the legal system provides a solution (regulatory failures). We recommend that you structure your case note as follows:

I - Introduction;

II - description of the case with factual background;

III - legal framework;

IV - analysing whether or not the legal system provides solutions;

V - recommendations;

VI - conclusion.



 



3. Length

A case note essay should be no longer than 2,000 words (footnotes not included). It should therefore be concise and work on your ability to choose whether to include relevant information.



 



4. Citation style.

You are asked to make references as footnotes based on the OSCOLA citation style.



 



5. Deadline for submission

The final paper is due one week after the workshop presentations. Students must upload an individual essay on the same topic presented.



FINAL EXAM: Students can decide to take a 3-hour final exam, with open consultation and based on all the course content.
